COVID-19: USDA Announces Details of Direct Payments Portion of Coronavirus Food Assistance Program 

On May 19, 2020, U.S. Secretary of Agriculture Sonny Perdue announced the direct payments portion of the Coronavirus Food Assistance Program (RIN 0503-AA65), which will provide $16 billion in direct payments to producers of wool, livestock, dairy, and specialty and non-specialty crops who have experienced a “five-percent-or-greater price decline due to COVID-19.”  Payments are limited to $250,000 “per person or entity” with exceptions for corporate entities of up to three shareholders who “contribute[] substantial labor or management” to operations.  USDA will accept applications for assistance beginning May 26, 2020 through August 28, 2020.  

 

Water Quality: Three State Attorneys General Notify EPA of Intent to Sue Over Chesapeake Bay TMDL Non-Compliance of Pennsylvania and New York

On May 18, 2020, the Attorneys General of Maryland, Virginia and the District of Columbia issued a joint letter to U.S. Environmental Protection Agency (EPA) stating that they “hereby give notice of their intent to sue EPA,” pursuant to 33 U.S.C. § 1366(a)(2), for failing to ensure that Pennsylvania and New York develop Phase III Watershed Implementation Plans (WIPs) that achieve and maintain nutrient reductions required by the established Chesapeake Bay Total Maximum Daily Load (TMDL). The notice alleges that EPA has breached its non-discretionary duty to ensure Pennsylvania and New York comply with their obligations, in violation of Section 117 (g)(1)(A) of the Clean Water Act.


COVID-19: DOJ Issues Antitrust Clearance for Coordinated Euthanization  

On May 15, 2020, the U.S. Department of Justice (DOJ) issued a Business Review Letter responding to a request seeking antitrust clearance for hog euthanasia from the National Pork Producers Council (NPPC).  In its request, the NPCC described the “need to euthanize . . . approximately 700,000 hogs per week,” explaining that decreased restaurant and foodservice demand is causing hogs to exceed 330 pounds and surpass production equipment capacities, thus becoming unmarketable.  In its letter, DOJ stated it “does not presently intend to challenge” NPPC’s Proposed Conduct to issue producer euthanasia guidance in conjuction with the U.S. Department of Agriculture, although the department specified it “reserves the right to challenge the conduct in the future if it is later revealed to be anticompetitive in purpose or effect.”  DOJ stated that its enforcement intentions are effective for one year. 


Biotechnology: USDA Publishes Revised Approval Process Regulations for Genetically Engineered Organisms

On May 18, 2020, USDA Animal and Plant Health Inspection Service (APHIS) published in the Federal Register a rule titled “Movement of Certain Genetically Engineered Organisms” (85 FR 29790), also called the “Sustainable, Ecological, Consistent, Uniform, Responsible, Efficient,” or “SECURE” rule.  The rule regulates the “importation, interstate movement, and environmental release” of genetically engineered organisms, and substantially overhauls the identification and review/permit process of plants subject to regulation for genetically engineered “plant pest risk” by focusing on a plant’s properties instead of “whether a plant pest was used in [its] development.”  The rule becomes effective in four stages following its publication, with full implementation by October 21, 2021


Pesticides: Maryland Governor Vetoes Chlorpyrifos Ban Legislation But MD Joins States Invoking Regulatory Ban 

On May 7, 2020, Maryland Governor Larry Hogan vetoed S.B.300, which would have prohibited chlorpyrifos use throughout the state.  In a letter accompanying the veto, the governor cited the Maryland Department of Agriculture’s promulgation of emergency regulations, effective March 27, 2020, which implement a 2021 phase-out of chlorpyrifos as “render[ing] moot” the legislative action.  See also Agricultural Law Weekly Review, March 26, 2020 —Maryland Bill Enacting Chlorpyrifos Ban Awaits Governor’s Action.


Food Policy: USDA Appeals SNAP Ruling

On May 12, 2020, the U.S. Department of Agriculture filed notice appealing a preliminary injunction issued in D.C., et al. v. U.S. Dep’t of Agric., et al., No. 20-119, which barred the implementation of a rule publishsed a 84 FR 66782 that would have toughened SNAP benefit work requirements for able-bodied adults without dependents. 


Biofuels: PA Governor Requests Renewable Fuel Standard Waiver

On May 11, 2020, Pennsylvania Governor Tom Wolf issued a letter to the U.S. Environmental Protection Agency (EPA) restating his November 2018 request to reduce or waive Renewable Fuel Standard volume requirements. This is Governor Wolf’s third such request.  The first was made in November 2017, to which EPA issued a letter in response seeking additional information. The second request of November 2018 generated no EPA response.   


Agricultural Transportation: FMCSA Extends Trucking Hours of Service Waiver Until June 14, 2020

On May 13, 2020, the U.S. Department of Transportation’s Federal Motor Carrier Safety Administration issued a further extension and expansion of its Emergency Declaration No. 2020-002, which waives hours of service limits for transport of “essential supplies,” including food, feed and livestock, until June 14, 2020.  The Emergency Declaration, which had been set to expire on May 15, 2020, was originally issued on March 13, 2020 and further extended on April 8, 2020.
